R. v. R.N.

Client, a young offender, was charged with possession of property obtained by crime after police located him and others following a reported break-in attempt. The client had made a statement to police admitting the property in his possession was stolen. Despite the admission, we negotiated a diversion program with the Crown. Upon completion, the charge was withdrawn.

Outcome: No youth record, no trial, charge withdrawn completely.

Bail Granted

Assault with a Weapon, Break and Enter, and Weapons Offences

R. v. J.M.

Client faced over ten charges including assault with a weapon, break and enter, uttering threats, and possession of incendiary material. He allegedly entered a home while masked and armed with a samurai sword, hatchet, and gasoline, then attacked a resident and poured gasoline throughout the house. Despite strong Crown opposition and a lengthy criminal record with prior weapons and violent offences, we secured his release.

Outcome: Bail granted despite serious charges and extensive criminal history, client released pending trial.

Theft, Assault with Intent to Resist Arrest, Possession of Stolen Property

R. v. T.L.

Client faced charges of theft under $5,000, assault with intent to resist arrest, and possession of stolen property after an incident at a retail store. Store security alleged the client concealed items and assaulted a security officer during an attempted arrest. We negotiated with the Crown and secured a withdrawal of all charges before trial with no admission of guilt.

Outcome: No criminal record, no admission of guilt, all charges withdrawn completely.

R. v. P.W.

Client was charged with break and enter into a dwelling. He allegedly entered a private garage attached to a home and stole several thousand dollars worth of equipment and personal property. We successfully had the charge withdrawn before trial.

Break and Enter, Mischief, and Assault

R. v. A.W.

Client was charged with two counts of break and enter, mischief under $5,000, and assault. He allegedly broke into his ex-girlfriend’s home by forcing open the door, then dragged her from her bedroom and pushed her onto a couch. A criminal record would have ended his pursuit of a law career. We used the complainant’s reluctance to convince the Crown the case was weak.

Outcome: All charges withdrawn after signing a peace bond, no criminal record, law career preserved.

Drug Possession, Possession of Stolen Property

R. v. D.S.

Client was charged with possession of a controlled substance and possession of stolen property. Police observed three of the client’s friends in a stolen vehicle. When spotted, the occupants fled and police gave chase. Officers alleged they saw the client pull a bag of marijuana from his pocket and drop it while running. On the morning of trial, we demonstrated there was no reasonable prospect of conviction and the Crown withdrew all charges.

Outcome: All charges withdrawn, no criminal record.
